Beatz LLC (“Beatz,” “we,” “us,” “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you use Beatz software, website, or related services (collectively, the “Services”).

B. Payment Information

All payment transactions are processed securely by Stripe, Inc. Beatz LLC does not store full credit card numbers. Stripe processes payment information in accordance with its privacy policy: stripe.com/privacy.

C. Automatically Collected Information

We may collect limited technical data such as:

• Device type
• Operating system
• Application version
• License status
• Crash logs
• Anonymous usage diagnostics (if enabled)

If the Software runs locally, generated music files remain on your device unless you upload them elsewhere.

2. WHAT WE DO NOT COLLECT

Beatz LLC does not:

• Collect or store generated music files
• Train AI models on your content
• Scrape copyrighted music
• Sell personal information
• Share data for advertising purposes
• Retrain foundational AI models using user-generated content

3. HOW WE USE INFORMATION

We use information to:

• Provide and maintain the Software
• Process subscriptions
• Manage licenses
• Improve performance and stability
• Provide support
• Prevent fraud or abuse
• Comply with legal obligations

We do not use your data to train AI systems.

4. STRIPE BILLING & SUBSCRIPTIONS

Payments are processed by Stripe.

When subscribing:

• You authorize recurring billing (if applicable)
• Fees are charged in advance
• Subscriptions renew automatically unless canceled
• Taxes may apply based on jurisdiction
• Beatz LLC does not control Stripe’s data practices
• Refunds are governed by our License & Terms

Failure to pay may result in suspension or termination of your license.

5. DATA SECURITY

We implement commercially reasonable safeguards to protect personal information. However, no method of transmission over the Internet or electronic storage is 100% secure. Use of the Services is at your own risk.

6. DATA RETENTION

We retain personal information only as long as necessary to: maintain your account, comply with legal obligations, resolve disputes, and enforce agreements. Billing data retention may be governed by Stripe’s policies.

7. USER RIGHTS

Depending on your jurisdiction, you may have rights to:

• Access your data
• Correct inaccurate data
• Request deletion
• Restrict processing
• Object to certain uses

8. CHILDREN’S PRIVACY

We are not responsible for third-party privacy practices.

11. DMCA SAFE HARBOR

Beatz LLC complies with the Digital Millennium Copyright Act (17 U.S.C. §512). If you believe content associated with our Services infringes your copyright, you may submit a DMCA notice to:

Beatz reserves the right to remove or disable access to allegedly infringing content. Beatz operates as a software provider and does not host user-generated music files unless separately stated.

12. AI SIMILARITY DISCLAIMER

Due to the probabilistic nature of AI systems:

• Generated music may resemble existing works
• Similar outputs may be generated for multiple users
• Beatz does not guarantee uniqueness
• Beatz does not guarantee copyright protection eligibility
• Users are solely responsible for determining suitability and legality of generated content
• Beatz LLC disclaims liability for claims related to similarity of output

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Beatz LLC shall not be liable for:

• Indirect or consequential damages
• Lost profits
• Lost data
• Business interruption
• Claims related to AI output similarity

Total liability shall not exceed the amount paid by you in the previous twelve (12) months.

14. ARBITRATION AGREEMENT

Any dispute arising from or relating to this Privacy Policy or the Services shall be resolved by binding arbitration in the State of Nevada. Arbitration shall be conducted on an individual basis.

• You waive any right to a jury trial.
• You agree that disputes may not be brought as class, collective, or representative actions.

15. CLASS ACTION WAIVER

You agree that:

• All disputes must be brought in your individual capacity
• You waive participation in any class action, consolidated action, or representative proceeding

If this waiver is found unenforceable, arbitration provisions shall remain in effect.

16. GOVERNING LAW

This Privacy Policy is governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
